Establishing liability in a trucking accident

On Behalf of | Apr 21, 2025 | Tort Litigation

It is difficult to travel in the Dallas-Fort Worth area without sharing the road with large trucks. Like other highly populated areas, semi-trucks and tractor-trailer trucks are heavily relied on to transport shipments and goods to and from their destinations. While truck drivers are held to a higher standard, they are also trained to operate these vehicles safely and ensure they understand and comply with federal regulations.

Unfortunately, specialized training and countless hours logged behind the wheel does not make truck drivers immune to automobile collisions. In fact, one could argue that the long driving shifts and long-distance trips would create a greater risk for trucking accidents. These, along with other factors, often contribute to the serious and fatal truck crashes occurring in Texas and nationally.

Trucking accident liability is not usually straightforward. These cases involve are often complex collisions, involving numerous parties and factors. As such, it is important to consider all factors and evidence involved to help establish cause. Once cause is determined, liability can be assigned to the party or parties at fault.

Truck drivers are often held liable for a truck accident; however, their employer may also be liable. Similarly, if there were issues specific to the truck itself and it was discovered that it was not properly maintained or repaired, the mechanic could face liability as well.

We have represented both the injured and trucking companies. Both deserve their time in court, and the best representation they can find.
