In Texas, trucking companies are in constant jeopardy of facing a legal claim if there is an accident or incident. While many accidents occur due to circumstances, others happen because of preventable issues. It is wise for these companies to protect themselves as much as possible to ensure their fleet is safe. Of course, when there is an accident, it is essential to explore all avenues of defense.
Tanker trucks have inherent risks that companies should mitigate
The importance of tanker trucks came to the forefront in recent years as various national emergencies occurred. As crucial as they are, accidents are unfortunately common. The National Highway Traffic Safety Administration released the numbers for crashes and how problematic they can be. Safety experts listed the causes of many accidents while giving advice on how to prevent them.
The NHTSA says that these vehicles are prone to rollovers with 1,300 such incidents annually. Large trucks are vulnerable to this problem as well with 500 happening each year. Six in 10 lead to a fatality. When tankers are carrying flammable materials and the vehicle rolls over, it can cause an explosion, a fire or spill hazardous liquids.
Companies and operators are advised to be cognizant of preventative steps such as checking the wheels; wearing safety equipment; ensuring qualified people are in the work areas where tankers are kept; and to make sure the cargo is properly secured.
Drivers can also cause accidents with their behavior or lack of vigilance. Drowsy driving is common with truckers who are on the road for long stretches and need to get their delivery to its destination at a specific time. They might go beyond the regulated duration for which they can be on the road and leave themselves vulnerable to drowsiness.
Distraction is a problem for all drivers, but it is particularly risky for truckers. Since the job can be repetitive, it is tempting to check devices while driving. Companies have policies against it, but they must be enforced. Bad weather and other drivers on the road are variables that can lead to accidents.
Truck companies need to know they are protected
A truck collision – especially one involving a tanker – can have severe consequences to those involved. In these incidents, trucking liability is a topic up for dispute. Truck companies should be shielded as much as possible to ensure they are not liable for accidents and have a good chance of showing they took all the necessary steps to make certain their vehicles were safe and their drivers professional.
